The legal battle over the recruitment of the next Teachers Service Commission CEO is heading to a full trial, a move that will prolong leadership uncertainty at the nation's teacher management body and scrutinize the constitutionality of its hiring laws.

MOMBASA, KENYA – The Employment and Labour Relations Court has ordered a full hearing for a case challenging the recruitment process for the Chief Executive Officer of the Teachers Service Commission (TSC), ensuring continued legal scrutiny over the appointment of one of Kenya's most critical education posts. The ruling, delivered in Mombasa, extends the leadership uncertainty at the helm of the commission, which oversees hundreds of thousands of teachers nationwide. The case consolidates two separate petitions that question the legality and constitutionality of the hiring criteria.
The legal challenge was initiated in May 2025 when petitioners, including Thomas Mosomi Oyugi, successfully sought interim orders to halt the recruitment process. The core of the lawsuit contests Section 16(2) of the TSC Act, which mandates that candidates for the CEO position must possess a degree in education. The petitioners argue this requirement is discriminatory and unconstitutional, as it unfairly excludes qualified professionals from other relevant fields like finance, human resources, and public administration. They contend that the role's responsibilities extend beyond education and that the current law is "illogical and mischievously designed to favour one class of Kenyans," namely teachers and insiders at the commission.
The lawsuit also raised procedural issues, arguing that the TSC advertised the position on May 6, 2025, without a formal declaration of a vacancy, as the incumbent CEO, Dr. Nancy Macharia, was still in office. Dr. Macharia's second five-year term concluded on June 30, 2025, after a decade of service. Furthermore, the petitioners criticized the 21-day application window as being unreasonably short and discriminatory, given the country's diversity.
In its defense, the TSC, through its chairperson Dr. Jamleck Muturi, has argued that the petition is an attempt to interfere with the independence of a constitutional commission. The commission maintains that its recruitment process is lawful, transparent, and guided by the TSC Act. The TSC's legal counsel has asserted that the court lacks jurisdiction to interfere with the internal recruitment affairs of a constitutional body. They argue that requiring an educator to lead an institution that manages the teaching profession is a logical and constitutional criterion. The respondents in the case include the TSC, the National Assembly, the Cabinet Secretary for Education, and the Attorney-General.
The ruling by Justice Ocharo Kebira of the Employment and Labour Relations Court in Mombasa to proceed to a full trial means the interim orders halting the recruitment process remain in effect. The court has consolidated the petitions from Thomas Mosomi Oyugi and Peter Kibelesi Kukobo, noting they raise similar constitutional questions. A subsequent ruling on the matter is anticipated, with court documents indicating a mention for the consolidated cases is scheduled for December 11, 2025. This protracted legal battle holds significant implications for the governance and stability of Kenya's education sector. The outcome will not only determine the future leadership of the TSC but also set a precedent on the interpretation of constitutional principles of equality, fairness, and the operational autonomy of independent commissions in public sector appointments.
