Judicial errors cited as appeals court clears one man and orders fresh trials for two others in high-profile 'bucks party' assault case.

Three men previously convicted of a harrowing gang rape involving teenage victims have successfully overturned their verdicts, a decision that has thrown a high-profile sexual assault case back into legal limbo.
The New South Wales Court of Criminal Appeal ruled on Monday that the original trial judge had misdirected the jury, rendering the convictions unsafe. This development underscores the rigorous, often fragile nature of criminal procedure in Commonwealth legal systems—a framework shared by Kenya—where a single judicial error can dismantle years of prosecutorial work.
Maurice Hawell, 31, his younger brother Marius, 24, and Andrew David, 31, were initially found guilty following a joint trial that spanned nearly four weeks in 2024. The charges stemmed from a "bucks party" (bachelor party) weekend, during which three women were sexually assaulted.
However, the appellate panel found merit in the defense's argument that the trial judge’s instructions to the jury were flawed and that the verdicts were, in legal terms, unreasonable. Consequently, the court quashed the convictions for all three men.
Justice Belinda Rigg delivered the specific orders regarding the future of the accused:
The decision to order a retrial for two of the men means the victims may once again be called upon to testify, a prospect that often carries significant emotional weight in sexual assault proceedings. While the specifics of the judicial errors remain a matter of complex legal record, the outcome serves as a stark reminder of the high burden of proof and procedural perfection required in serious criminal cases.
As the case returns to the district court, prosecutors must now prepare to present their evidence anew against Maurice Hawell and Andrew David, while Marius Hawell walks free, his legal battle concluded.
