Luis David Nino-Moncada, a Venezuelan national shot by Border Patrol agents last week, has pleaded not guilty to assaulting a federal officer, setting up a courtroom battle that will scrutinize the use of force by Trump’s border agencies.
The incident occurred during a traffic stop in Portland. Agents allege Nino-Moncada used his pickup truck as a weapon, reversing into their vehicle. However, the defense argues he was fleeing out of fear, unaware that the men in unmarked cars were law enforcement. Nino-Moncada was shot in the arm; his passenger, Yorlenys Betzabeth, was also wounded.
Crucially, federal investigators admit there is no body-cam footage of the shooting. This lack of transparency has infuriated local leaders.
