NEMA has instructed businesses with environmental licence applications filed before 1 August 2025 to resolve outstanding technical issues by 30 September or risk having their applications decided without further input or require fresh submissions.
Nairobi, Kenya — 2025-09-17 12:00 EAT. NEMA has directed all applicants who filed environmental licence requests before 1 August 2025 to visit their respective NEMA offices by 30 September to resolve pending technical issues or risk decisions based only on current files.
NEMA’s 17 September notice instructs in-person follow-ups so technical reviews can be completed before issuing a Record of Decision. Those who fail to act may be required to re-apply under the Environmental Management and Coordination Act (EMCA). Status: ongoing.
This comes months after NEMA deployed the ENVIS and ERP systems for online licensing and real-time data sharing. While digitisation aims to cut delays, environmental groups criticised the rollout for limited public participation.
EMCA (Cap. 387): Governs EIA, licensing, and Records of Decision.
Mandate: NEMA reviews EIAs and licences; lead agencies provide technical inputs.
Next steps per law: Applicants supply clarifications or additional studies; NEMA issues approvals with conditions or declines with reasons.
NEMA: Urges all pre-August applicants to contact the original receiving office and appear by the deadline.
Civil society: Warns that process changes must include meaningful public input.
Cut-off cohort: Applications lodged before 1 Aug 2025.
Deadline: 30 Sept 2025 (office visit/clarifications).
Systems: ENVIS + ERP live; aimed at end-to-end e-licensing.
Project delays: Non-compliant files may be decided as-is or forced to restart, affecting timelines and finance.
Legal exposure: Weak stakeholder engagement can trigger appeals or judicial review.
Administrative load: NEMA offices may face surges near deadline.
