A high-stakes legal battle has erupted at the High Court, challenging the Marriage Act’s power to declare unregistered customary unions void—a move that could salvage the inheritance rights of thousands of widows.
Lawyer Rogers Monda argues the state has weaponized administrative paperwork to erase cultural legitimacy. By making registration the source of validity rather than proof, the law effectively disinherits women who married under traditional rites but lack a government certificate.
The petition targets the controversial sections of the Marriage Act 2014, which mandate that all customary marriages must be registered within six months. Monda contends that this requirement is unconstitutional, as it elevates a bureaucratic process above the actual cultural rites—like ruracio or ayie—that constitute the marriage in the eyes of the community.
"A marriage is formed by the consent of the parties and their families, not by a rubber stamp from the Sheria House," Monda told the press outside the Milimani Law Courts. "To say a woman who has lived with a man for 40 years is a 'stranger' simply because she lacks a slip of paper is a gross violation of human dignity."
If successful, this petition could force a retroactive validation of millions of unions currently in legal limbo. It challenges the colonial hangover that views African customary law as inferior to statutory civil marriage.
