The barbaric practice of treating human beings as collateral for debt is facing its final days in Kenya. A landmark legislative push by Kirinyaga Woman Representative Jane Njeri Maina to criminalize the detention of patients and corpses over unpaid medical bills has successfully advanced to the Second Reading, signaling a major victory for human rights advocates.
For decades, Kenyan hospitals have operated like prisons for the poor, locking up mothers who cannot pay delivery fees and holding bodies hostage in morgues to extort families. Maina’s Health (Amendment) Bill, 2024, seeks to shatter this cruel business model by imposing severe criminal penalties—including fines of up to KSh 3 million—on any administrator who demands prepayment for emergency care or detains a patient for debt.
During the debate in Parliament, Maina painted a harrowing picture of the current system, arguing that it violates the most basic constitutional guarantees of dignity (Article 28) and the right to emergency treatment (Article 43). She cited heartbreaking cases where grieving families were denied the right to bury their loved ones, prolonging their trauma solely because they lacked money.
The legislation goes beyond punishment; it attempts to realign the entire healthcare ethos of the nation. It redefines "emergency treatment" to include care during transport and admission, closing loopholes that hospitals used to turn away critical patients. While private hospitals may resist, the moral weight of the Bill is undeniable.
"Poverty should not be a death sentence, nor a reason for imprisonment in a hospital ward," Maina asserted. As the Bill moves closer to becoming law, it offers a glimmer of hope that Kenya’s healthcare system will finally prioritize the sanctity of life over the balance sheet.
