The court dismisses a petition against the TSC CEO recruitment process, allowing the commission to appoint a successor to Nancy Macharia and end months of leadership uncertainty.

The Employment and Labour Relations Court has dismissed a petition blocking the recruitment of the next Teachers Service Commission (TSC) CEO, ending months of paralysis at the helm of the country’s largest employer.
Justice Monica Mbaru’s ruling clears the path for the Commission to find a successor to Dr. Nancy Macharia, who retired in June 2025. The recruitment process had been frozen by litigation challenging the statutory requirement that the CEO must hold an education degree, a clause petitioners argued was discriminatory and designed to ring-fence the position for "insiders."
The petitioner, Thomas Mosomi Oyugi, had argued that Section 16(2) of the TSC Act violated the constitution by locking out qualified professionals from fields such as human resources, law, and finance. He contended that managing a workforce of over 400,000 teachers requires executive management skills, not necessarily a background in pedagogy.
However, the court ruled that the legislature acted within its mandate to prescribe specific qualifications for the head of a specialized constitutional commission. "The unique mandate of the TSC requires a deep understanding of the teaching profession," Justice Mbaru noted. "To divorce the leadership from the profession is to invite administrative dissonance."
The ruling is a significant victory for the Commission's autonomy but places immense pressure on the selection panel to deliver a candidate who can bridge the gap between the government's fiscal constraints and teachers' demands.
With the legal hurdles cleared, the race for one of the most powerful offices in the public service officially restarts. The successful candidate will not only manage a multi-billion shilling budget but will define the trajectory of the teaching profession in the era of the Competency-Based Curriculum.
