In a controversial ruling, a Nigerian Federal High Court has issued an injunction preventing the Economic and Financial Crimes Commission (EFCC) from investigating or freezing the accounts of Jones Creek Hydrocarbon.
A Federal High Court in Abuja has dramatically halted the EFCC's probe into Jones Creek Hydrocarbon Limited, a prominent affiliate of the Nestoil Group, sparking outrage among anti-corruption activists.
The preemptive injunction strikes at the heart of Nigeria's anti-graft crusade. By restricting the EFCC's constitutional mandate to investigate multi-billion naira corporate entities, the judiciary risks cementing a perception that powerful oil conglomerates operate above the law.
Presiding Judge P.O. Lifu issued an interim injunction explicitly forbidding the EFCC from disrupting the company's operations, seeking interim forfeiture, or pursuing a Mareva injunction. The order remains in effect pending the hearing of a motion on notice.
The ruling occurs against a backdrop of complex, high-stakes corporate litigation. Neconde Energy, affiliated with the Nestoil Group, is currently battling a multi-billion naira debt default case at the Supreme Court. The principals of these firms wield immense influence in Nigeria's lucrative oil sector, making the EFCC's investigation highly sensitive.
Legal experts and civil society groups have labelled the court's intervention as "shocking and extraordinary." The use of preemptive injunctions to gag law enforcement is seen as a dangerous precedent that undermines the EFCC's authority and damages investor confidence in Nigeria's regulatory frameworks.
"It is highly unusual for a judge to preempt law enforcement and restrict its ability to carry out constitutional duties," noted a leading anti-corruption advocate.
