Consumer watchdog argues Francis Meja cannot be promoted while sitting as a commissioner, citing gross statutory violation and lack of competitive process.

The Consumer Federation of Kenya (COFEK) has moved to court to stop the vetting of Francis Meja as the new Public Service Commission (PSC) chairperson. The watchdog argues that Meja’s nomination by President William Ruto is "unconstitutional and a gross conflict of interest."
Meja, the former Director-General of the NTSA, is currently a serving commissioner at the PSC, having been appointed in January 2025. COFEK’s petition posits a legal conundrum: Can a sitting commissioner be promoted to chair the same commission without first resigning and undergoing a cooling-off period?
"You cannot audit yourself," argued COFEK Secretary General Stephen Mutoro."Mr. Meja is currently part of the commission's decisions. To elevate him to Chair creates an incestuous environment where accountability is sacrificed on the altar of political patronage. We are asking the court to declare this nomination null and void."
The petition also raises questions about the recruitment process. COFEK claims the position should have been subjected to a competitive process open to the public, rather than an internal elevation which they term a "boardroom deal."
The battle is set to spill over into the National Assembly, where MPs are gearing up for the vetting process. Opposition MPs have already signaled they will back COFEK’s stance, setting the stage for a heated debate.
As the court prepares to give directions, the PSC finds itself in limbo. The outcome of this case will define the boundaries of executive appointments and the independence of constitutional commissions for years to come.
